Terms & Legal Notice

Legal Notice

1. Seller and scope

These Terms apply to consumer purchases of physical goods from dragyx.com. The seller is Matthias Neumann, a sole proprietor trading as Dragyx. Full operator and contact details appear in the Legal Notice below.

A consumer is a person acting outside their trade, business or profession within the meaning of applicable law. Separately negotiated business orders or services require terms appropriate to those transactions. Mandatory consumer rights take precedence over any conflicting provision in these Terms.

2. Products and production

We sell clothing, including jerseys and windbreakers. The relevant product page describes the product, its materials, available sizes and other main characteristics. Please check the size guide before ordering.

We work with a specialist production and fulfilment partner. Items are generally made after ordering. Your sales contract is with Dragyx; our production partner’s internal return or reimbursement rules do not replace your legal rights against us.

Screen settings can affect how colours appear, and the permitted characteristics of a product are those described and agreed before purchase. This does not authorise a materially different item or exclude your right to receive goods that conform to the contract.

3. Ordering and contract formation

Product listings invite you to place an order. You can select items, review your cart and correct your details before submitting the order. The final checkout button indicates that submitting the order involves an obligation to pay.

By submitting the order, you make an offer to purchase the selected goods. We accept it when we send you a confirmation accepting the order or collect the payment, whichever occurs first. A payment authorisation alone is not payment collection. Any message that expressly states that it only acknowledges receipt and does not accept the order is not an acceptance.

The contract language is English. We provide confirmation of the contract and the applicable Terms, withdrawal information and model withdrawal form by email or another durable medium. Please retain them. You may also save or print the information before ordering. We retain order details in our shop administration; you may contact us for help identifying or obtaining information about your order. No customer account is required to place an order.

4. Prices, taxes and payment

The currency, applicable product price, shipping charge and final total payable to us are shown before you submit your order. Prices include taxes that must be included under the applicable rules. We do not add undisclosed charges after you have ordered.

Dragyx operates under the Austrian small-business VAT exemption where its statutory requirements apply. For transactions covered by section 6(1)(27) of the Austrian VAT Act 1994, no Austrian VAT is separately charged. This does not mean that every cross-border transaction is exempt from foreign taxes or import charges.

Available payment methods are shown at checkout. Payment is due when ordering unless the selected payment method expressly provides a different due date. Any separately agreed deferred-payment or instalment arrangement follows the disclosed terms of that payment provider. Import charges payable to a carrier or authority are explained in our Shipping & Delivery policy and the relevant information before purchase.

5. Delivery

Delivery availability, charges and periods are described in our Shipping & Delivery policy and the product and checkout information provided before purchase. A stated overall delivery period includes production and transport.

If a delivery problem occurs, contact dragyx.service@gmx.at. We remain responsible for our contractual obligations. Your remedies are not conditional on you pursuing our production partner or the carrier yourself.

For consumer orders, accidental loss or damage normally remains our risk until you, or a person you designate other than the carrier, receive the goods. The statutory exception for a carrier independently commissioned by you and not offered by us remains unaffected.

6. Order changes, withdrawal and exchanges

Orders can move into production quickly. If you need a correction or wish to cancel, contact us immediately. We do not promise a voluntary cancellation or editing window after an order has been placed. A requested change may no longer be technically possible once production or dispatch has progressed.

This does not affect an existing statutory right of withdrawal, including a right exercised before delivery, or your rights concerning defective goods. The withdrawal notice, return procedure, return costs and model form are set out in our Returns & Withdrawal policy.

We do not provide a separate voluntary change-of-mind return or size/colour exchange. Where withdrawal is legally available, you may withdraw and, if you wish, place a new order. Choosing a standard size or existing design, or manufacturing only after ordering, does not by itself exclude withdrawal.

If we separately offer goods made to individual customer specifications or clearly personalised goods, any applicable statutory exclusion will be explained before the order is placed. Personalisation does not remove rights concerning defects or incorrect supply.

7. Statutory rights concerning defective goods

You have the statutory legal guarantee of conformity. For consumer purchases governed by Austrian law, we are generally responsible for defects present at delivery that become apparent within two years after delivery. Applicable rules on proof, time limits and more favourable mandatory protection remain unaffected.

You may initially choose repair or replacement, subject to the statutory rules on impossibility and disproportionate cost. A remedy must be provided free of charge, within a reasonable time and without significant inconvenience.

For contracts to which the current Austrian Consumer Warranty Act rules apply, the guarantee period is extended once by one year when a defect is remedied by repair. Before providing the remedy, we inform you of the applicable choice between repair and replacement and the statutory extension where required.

If the legal conditions are met, you may seek a proportionate price reduction or terminate the contract and obtain a refund. Under Austrian law, a merely minor defect does not entitle you to terminate. We bear the necessary costs that the law requires us to bear when resolving a valid defect claim.

Contact us with the order details and a description of the issue. Photos can help us assess the problem, but they are not an absolute condition for your rights. We do not replace the statutory guarantee with our production partner’s shorter internal claim period, and your rights do not depend on our production partner agreeing to reimburse us.

8. Liability

Our liability is governed by applicable law. Nothing in these Terms excludes or limits liability where that would be unlawful, including mandatory liability for personal injury, intentional or grossly negligent conduct, or product liability.

9. Website content and personal data

Purchasing a product does not transfer intellectual-property rights in Dragyx designs, images or branding. Uses permitted by law remain unaffected.

Shopify provides our store platform, and our production partner supports production and fulfilment. Our Privacy Policy explains the processing of personal data, the services actually used, recipients and your choices and rights. These Terms do not constitute consent to optional advertising or tracking.

10. Complaints

Send complaints to dragyx.service@gmx.at or to the business address in the Legal Notice. We handle the complaint and explain the available next steps. Your right to contact a competent authority, dispute-resolution body or court remains unaffected. Where legally required after an unresolved complaint, we provide information about the competent alternative dispute-resolution body and our participation.

11. Applicable law and jurisdiction

Austrian law applies. If you are a consumer habitually resident in another country, this choice does not deprive you of mandatory protections that apply under the law of that country. Statutory rules on jurisdiction remain unaffected. These Terms do not impose an exclusive foreign court or compulsory private arbitration on you.

12. Applicable version

The version made available when your contract is concluded applies to that contract. Later changes do not retrospectively change existing contracts. Individually agreed terms prevail where legally permitted. If a provision is ineffective, the applicable statutory rules govern in its place.
